Yes, The Enclave was developed with its own entry sign, and landscaping/fencing around the perimeter. The Enclave falls under the covenants and restrictions of Heritage Parks; however, it also has additional restrictions unique to this area. The additional maintenance costs of landscaping/fencing around its perimeter are billable to the Enclave resident's lots only. Per the Enclave deed strictions, this will be billed as a special maintenance / replacement assessment against all Enclave Lots, if a quarterly maintenance fee is insufficient or not collected/funded. This Enclave maintenance fee (if collected) is a separate assessed fee and is NOT part of the HOA dues (HOA dues are charged to all HOA residents). These maintenance funds are to be separately accounted for and not combined with other HOA dues for any maintenance of Enclave area.

The cost of any construction, or maintenance is not the responsibility or billable to Heritage Park residents outside of the Enclave section and are the responsibility of all the homeowners in the Enclave section.
The current deed restrictions state that the "ownership" of the Enclave perimeter fence belongs to the Enclave homeowner whose property abuts that portion of the perimeter fence (There are 30 Enclave perimeter fence homeowners). This is important, according to our Attorney, in the instance of damage to the perimeter fence as a result of an accident or inevitable forces such as wind, hail, storm, or fire. These situations would normally be covered by the insurance provided by the affected party of any of these 30 Enclave perimeter fence homeowners. Outside of an accident or inevitable force of nature, this would require the HOA to maintain the Enclave perimeter fence, and the costs of providing that maintenance or replacement, is the responsibility of all of the 58 Enclave homeowners equally.
The fence by water retention area abutting the duplexes (duplexes are not part of the Enclave but are liable for damages or fire they cause to fence) under current deed restrictions, that fence section maintenance will be billable to all 58 Enclave residents.
Financial statements are available at the quarterly homeowner's meetings. This statement will outline all of the income and expenses of the Association for that previous quarter.

As a resident of Heritage Parks, you will need to maintain your property in the same manner as our homeowners. Any fines assessed against the property you are renting will be charged to the actual property owner and, in all probability, that charge will be passed on to you in some way.
